1. Agreement to Terms

By accessing or using NYN Rentals' car rental services, website, or applications (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

2. Rental Requirements

To rent a vehicle from NYN Rentals, you must:

• Be at least 21 years of age (25 for certain vehicle categories)
• Possess a valid driver's license that has been held for at least 1 year
• Have a valid credit or debit card in your name
• Successfully complete our identity verification process (see Section 6)
• Meet any additional requirements for specific vehicle categories

3. Reservations and Payments

3.1 Booking and Pricing

Reservations are subject to vehicle availability. A valid payment method is required to secure your booking. Prices may vary based on demand, season, vehicle category, and availability. All prices displayed include the base rental rate; additional fees for extras, fuel, tolls, and other services may apply.

3.2 Payment Processing

All payments are processed securely by Stripe, Inc. We do not store or have access to your full credit card number or CVV. By providing your payment information, you authorize us to charge your payment method for the rental amount and any applicable additional charges.

3.3 Registered User Discount

Registered users with an account may receive a discount on rental rates. The discount amount is displayed during checkout and is applied automatically.

4. Security Deposit

4.1 Security Deposit Charge

At checkout, a security deposit is charged along with your rental fee as a single payment. The deposit amount is clearly displayed during checkout. This deposit is fully refundable provided no issues arise during your rental.

4.2 Deposit Amount

The security deposit amount is set by NYN Rentals and may vary. The current deposit amount will be clearly displayed before you complete your booking.

4.3 Deposit Refund

If no issues arise during your rental, the security deposit will be automatically refunded within 24 hours after your trip ends. Depending on your bank or card issuer, it may take an additional 5-10 business days for the refund to appear on your statement.

4.4 Deposit Deductions

NYN Rentals reserves the right to retain all or part of the security deposit in the event of:

• Vehicle damage — damage to the vehicle beyond normal wear and tear
• Low fuel — returning the vehicle with less fuel than provided at pickup
• Traffic violations — traffic tickets, tolls, or parking fines incurred during the rental period
• Excessive cleaning — vehicle returned in a condition requiring professional cleaning
• Late return — returning the vehicle significantly past the agreed drop-off time
• Other damages or losses — any other costs arising from a breach of these Terms

If the security deposit does not cover the full amount owed, you agree that additional charges may be applied to your payment method on file.

5. Additional Charges

You may be charged additional fees after your rental for the following reasons:

• Damage to the vehicle (including windshield, tires, and interior)
• Toll charges incurred during the rental period
• Fuel surcharges for returning the vehicle without a full tank
• Late return fees
• Cleaning fees for excessive mess or odor (e.g., smoking)
• Traffic or parking tickets received during the rental
• Loss of vehicle keys or accessories

Additional charges may be deducted from your security deposit or charged separately to your payment method on file. You will be notified of any additional charges and may be provided with supporting documentation (e.g., photos, receipts).

6. Identity Verification

6.1 Verification Requirement

All renters must complete an identity verification process before picking up a vehicle. This verification is conducted through Stripe Identity, a third-party identity verification service.

6.2 Verification Process

During the verification process, you will be asked to:

• Provide a photograph of a valid government-issued identification document (e.g., driver's license, passport, national ID card)
• Take a selfie photograph for facial comparison with your identification document

6.3 Data Processing

Your identity documents and selfie are processed by Stripe to extract and verify your personal information, including your name, date of birth, address, and document details. Biometric data (facial geometry) is used for identity matching. By completing the verification, you consent to this data collection and processing. For more details, see our Privacy Policy.

6.4 Verification Outcome

NYN Rentals reserves the right to decline a rental if identity verification fails or cannot be completed. We may also require manual review of verification results before approving a rental.

7. Vehicle Use

The rented vehicle may only be driven by authorized drivers listed on the rental agreement. The vehicle must not be used:

• For any illegal purpose
• To transport hazardous materials
• For commercial purposes (unless specifically agreed in writing)
• For racing, testing, or driver training
• Outside the island of Oahu, Hawaii (unless approved in advance)
• While under the influence of alcohol or drugs
• To tow or push another vehicle
• On unpaved roads or off-road terrain
• By any person who does not meet the rental requirements in Section 2

8. Insurance and Protection

8.1 Personal Insurance Requirement

Vehicle insurance is not included with your rental. You are required to carry your own valid auto insurance that covers rental vehicles. You are financially responsible for any damage to the vehicle during the rental period.

8.2 Rentals Collision Protection (RCP)

Optional Rentals Collision Protection (RCP) is available for purchase during checkout. RCP provides coverage for vehicle damage during the rental period, subject to its own terms and conditions. RCP does not replace the requirement for personal auto insurance.

8.3 Reporting Incidents

You agree to report any accident, theft, damage, or mechanical issue immediately to both local authorities (when applicable) and NYN Rentals. Failure to report incidents promptly may result in additional liability.

9. Cancellation and Modification Policy

9.1 Free Cancellation

Free cancellation is available up to 24 hours before the scheduled pickup time. Cancellations made within this window will receive a full refund of the rental amount.

9.2 Late Cancellation

Cancellations made less than 24 hours before the scheduled pickup time will incur a cancellation fee. The cancellation fee is a percentage of the total rental amount and will be clearly disclosed at the time of cancellation. Additionally, third-party payment processing fees (including Stripe transaction fees) are non-refundable and will be deducted from the refund amount.

9.3 No-Shows

Failure to pick up the vehicle at the scheduled time without prior cancellation constitutes a no-show and may result in forfeiture of the full rental amount.

9.4 Booking Modifications

You may request modifications to your booking (e.g., date changes, vehicle upgrades). Modifications are subject to availability and may result in a price change. If the modified booking has a higher price, you will be required to pay the difference. If the price is lower, you will receive a refund for the difference.

10. Refunds

10.1 Refund Processing

Approved refunds are processed through Stripe to your original payment method. Refunds typically appear on your statement within 5–10 business days, depending on your bank or card issuer.

10.2 Processing Fees

Third-party payment processing fees (including fees charged by Stripe and other service providers involved in processing your transaction) are non-refundable. For all refunds — including cancellations made within the free cancellation window — these non-recoverable processing fees will be deducted from the total refund amount. The exact fee deduction will be transparently displayed during the refund process.

11. Return of Vehicle

Vehicles must be returned to the designated drop-off location at the agreed time with a full tank of fuel (unless a prepaid fuel option was selected). Late returns may incur additional daily or hourly charges. You are responsible for any tolls, parking fees, or traffic violations incurred up to the time of return.

12. Damage and Repairs

You are responsible for the condition of the vehicle during your rental period. Pre-existing conditions are documented during vehicle inspection at pickup. Any new damage discovered upon return will be assessed and charged accordingly. Do not attempt repairs without prior authorization from NYN Rentals.

13. Privacy

Your personal information, including identity verification data and payment information, is collected and processed in accordance with our Privacy Policy. By using our Services, you consent to this data collection and processing.

14. Limitation of Liability

To the maximum extent permitted by law, NYN Rentals shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our Services. Our total liability shall not exceed the amount paid for the specific rental giving rise to the claim.

15. Indemnification

You agree to indemnify, defend, and hold harmless NYN Rentals, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the vehicle, violation of these Terms, or infringement of any third-party rights.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Hawaii, United States. Any disputes arising from these Terms or your use of our Services shall be resolved in the courts located in Honolulu, Hawaii.

17. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website with an updated "Last updated" date. Continued use of our Services after changes are posted constitutes acceptance of the modified Terms.
