NYN Rentals (Noyan Trade LLC)

1. Agreement to Terms
By accessing or using Noyan Trade LLC's car rental services, this website, or any related applications (collectively, the "Services"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, do not use the Services. These Terms supplement — and do not replace — the separate written rental agreement you sign at vehicle handover, which governs the operational details of your rental.
2. Affiliated Fleet Partner
NYN Rentals operates an affiliated fleet partnership with Alp Hawaii LLC, which trades as Alp Hawaii at alphawaii.com. Through that partnership, our vehicle listings may include vehicles operated by Alp Hawaii. Cars operated by Alp Hawaii are clearly labeled on our website with an "Operated by Alp Hawaii" badge.
If you select a vehicle operated by Alp Hawaii, your booking will be completed through Alp Hawaii's website, under Alp Hawaii's rental agreement and pricing. Before continuing, we will show you a confirmation dialog disclosing this referral. By clicking "Continue to Alp Hawaii" you (a) consent to a limited transfer of your booking context toAlp Hawaii as described in our Privacy Policy, and (b) acknowledge that the resulting rental agreement is with Alp Hawaii, not with Noyan Trade LLC. Noyan Trade LLC is not a party to any rental contract you conclude on the partner site and is not responsible for the performance of that contract.
3. Rental Requirements
To rent a vehicle from NYN Rentals, you must:
- Be at least 21 years of age (25 for certain vehicle categories).
- Hold a valid driver's license that has been valid for at least 1 year.
- Possess a valid credit or debit card in your name.
- Successfully complete our identity-verification process (see Section 7).
- Meet any additional requirements applicable to specific vehicle categories.
4. Reservations, Pricing, and Payment
4.1 Booking
Reservations are subject to vehicle availability. A valid payment method is required to secure your booking. Prices may vary based on demand, season, vehicle category, and availability. All prices displayed include the base rental rate; additional fees for extras, fuel, tolls, and other services may apply.
4.2 Payment Processing
All payments are processed securely by Stripe, Inc. We do not store or have access to your full credit card number or CVV. By providing your payment information, you authorize us to charge your payment method for the rental amount, any optional add-ons you select (including purchased insurance coverage), and any applicable additional charges described in Section 6.
4.3 Registered User Discount
Registered users with an account may receive a discount on rental rates. The discount amount is displayed during checkout and is applied automatically.
5. Security Deposit
5.1 Charge
At checkout, a refundable security deposit is charged alongside your rental fee as a single payment. The deposit amount is clearly displayed before you complete your booking.
5.2 Refund
If no issues arise during your rental, the security deposit is automatically refunded within 24 hours after your trip ends. The refund may take an additional 5–10 business days to appear on your statement, depending on your bank or card issuer.
5.3 Deductions
NYN Rentals reserves the right to retain all or part of the security deposit in the event of: vehicle damage beyond normal wear and tear; returning the vehicle with less fuel than provided at pickup; traffic tickets, tolls, or parking fines incurred during the rental; vehicle returned in a condition requiring professional cleaning; late return significantly past the agreed drop-off time; or any other costs arising from a breach of these Terms. If the security deposit does not cover the full amount owed, you agree that additional charges may be applied to your payment method on file.
6. Additional Charges
You may be charged additional fees after your rental for: damage to the vehicle (including windshield, tires, and interior); tolls incurred during the rental period; fuel surcharges for returning the vehicle without a full tank; late-return fees; cleaning fees for excessive mess or odor (e.g., smoking); traffic or parking tickets received during the rental; and loss of vehicle keys or accessories.
Additional charges may be deducted from your security deposit or charged separately to your payment method on file. You will be notified of any additional charges and may be provided with supporting documentation (e.g., photos, receipts).
7. Identity Verification
All renters must complete an identity-verification process before picking up a vehicle. Verification is conducted through Stripe Identity. During the process, you provide a photograph of a valid government-issued identification document and a selfie for facial comparison. Your identity documents and selfie are processed by Stripe to extract and verify your personal information, including name, date of birth, address, and document details; biometric data (facial geometry) is used for identity matching. By completing verification, you consent to this data collection and processing as described in our Privacy Policy.
NYN Rentals reserves the right to decline a rental if identity verification fails or cannot be completed, and may require manual review of verification results before approving a rental.
8. Insurance and Protection
8.1 Choice at Checkout
NYN Rentals does not provide a default insurance policy with every rental. At checkout you must affirmatively choose one of the following two options:
- Use your own insurance. You confirm that you carry a valid auto-insurance policy that covers rental vehicles and that you will upload proof of insurance through the trip-management page after your booking is confirmed. You remain financially responsible for any damage to the vehicle during the rental period.
- Purchase optional coverage through us. You may purchase a rental-collision and liability coverage product (the "Coverage Product") offered at checkout. The Coverage Product is issued by Inuity Insurance Company (inuity.com); NYN Rentals is Inuity Insurance Company's authorized rental-agency partner and facilitates the purchase on your behalf. The resulting insurance contract is between you and Inuity Insurance Company; Noyan Trade LLC is not the insurer and is not a party to that contract. Before you pay, the product name, price, coverage limits, deductibles, exclusions, and provider disclosures are displayed and must be acknowledged with a recorded click. A copy of the coverage terms as they existed at purchase is saved against your booking. The Coverage Product does not replace any personal auto-insurance policy required by Hawaii law where applicable.
8.2 Adding Coverage After Booking
If you initially elected to use your own insurance, you may upgrade to the Coverage Product through the trip-management page at any time before your trip starts. The same point-of-sale disclosures and acknowledgment apply as at checkout. The upgrade is processed as a separate charge against the payment method on file for your booking.
8.3 Claims and Provider Contact
Claims, coverage questions, and policy documents for the Coverage Product are handled directly by Inuity Insurance Company. You will receive the policy certificate and contact details by email from Inuity Insurance Company after purchase. NYN Rentals can help route inquiries but is not authorized to adjust claims or amend the policy.
8.4 Reporting Incidents
You agree to report any accident, theft, damage, or mechanical issue immediately to both local authorities (when applicable) and NYN Rentals. Failure to report incidents promptly may result in additional liability and forfeiture of any purchased coverage benefits.
9. Permitted Use of the Vehicle
The rented vehicle may only be driven by authorized drivers listed on the rental agreement. The vehicle must not be used:
- For any illegal purpose.
- To transport hazardous materials.
- For commercial purposes (unless specifically agreed in writing).
- For racing, testing, or driver training.
- Outside the island of Oahu, Hawaii (unless approved in advance).
- While under the influence of alcohol or drugs.
- To tow or push another vehicle.
- On unpaved roads or off-road terrain.
- By any person who does not meet the rental requirements in Section 3.
10. Cancellations and Modifications
10.1 Free Cancellation
Free cancellation is available up to 24 hours before the scheduled pickup time. Cancellations made within this window will receive a full refund of the rental amount, excluding non-refundable third-party processing fees (see Section 11).
10.2 Late Cancellation
Cancellations made less than 24 hours before the scheduled pickup time incur a cancellation fee, disclosed at the time of cancellation. Third-party payment-processing fees are non-refundable and will be deducted from the refund amount.
10.3 No-Shows
Failure to pick up the vehicle at the scheduled time without prior cancellation is a no-show and may result in forfeiture of the full rental amount.
10.4 Modifications
You may request modifications to your booking. Modifications are subject to availability and may result in a price change. If the modified booking has a higher price, you will be required to pay the difference; if lower, you will receive a refund for the difference.
11. Refunds
Approved refunds are processed through Stripe to your original payment method. Refunds typically appear on your statement within 5–10 business days, depending on your bank or card issuer. Third-party payment-processing fees (including fees charged by Stripe and any other service providers involved in processing your transaction) are non-refundable; they will be deducted from every refund, including refunds made within the free cancellation window. The exact fee deduction is shown during the refund process.
12. Return of Vehicle
Vehicles must be returned to the designated drop-off location at the agreed time with a full tank of fuel (unless a prepaid fuel option was selected). Late returns may incur additional daily or hourly charges. You are responsible for any tolls, parking fees, or traffic violations incurred up to the time of return.
13. Damage and Repairs
You are responsible for the condition of the vehicle during your rental period. Pre-existing conditions are documented during vehicle inspection at pickup. Any new damage discovered upon return will be assessed and charged accordingly. Do not attempt repairs without prior authorization from NYN Rentals.
14. SMS / Text Messaging
By providing your mobile phone number when you create an account or complete a booking, you consent to receive transactional SMS messages from NYN Rentals related to your reservation and account. We do not send marketing or promotional SMS. Standard message and data rates from your mobile carrier may apply. You may opt out at any time by contacting +1 (808) 909-1272 or info@nynrentals.com; opting out does not cancel your booking or affect transactional emails. SMS delivery depends on your carrier and is not guaranteed; for time-sensitive matters please also monitor email and your account dashboard. Full details are in Section 7 of the Privacy Policy.
15. Privacy
Your personal information is collected and processed in accordance with our Privacy Policy, which explains the categories of information collected, the sub-processors involved (including Supabase, Stripe, Twilio, and the shared-database arrangement with our affiliated fleet partner), and your rights. By using the Services, you consent to that collection and processing.
16. Limitation of Liability
To the maximum extent permitted by law, Noyan Trade LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services. Our total aggregate liability under or in connection with these Terms or any rental booked through the Services shall not exceed the amount paid by you for the specific rental giving rise to the claim. Nothing in these Terms limits any liability that cannot be excluded under applicable law.
17. Indemnification
You agree to indemnify, defend, and hold harmless Noyan Trade LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the vehicle, violation of these Terms, or infringement of any third-party rights.
18. Governing Law and Venue
These Terms are governed by and construed in accordance with the laws of the State of Hawaii, United States, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the Services shall be resolved exclusively in the state or federal courts located in Honolulu, Hawaii, and you consent to personal jurisdiction and venue there.
19. Changes to Terms
We reserve the right to modify these Terms at any time. Changes become effective when posted to this page with an updated "Last updated" date and version. We will re-prompt for cookie consent on material changes. Continued use of the Services after changes are posted constitutes acceptance of the modified Terms.
